Offense Drivers License Regulation
5 DWIs in a Lifetime with Nothing Else Prevent Driver From Being Re-Licensed
3+ DWIs and a “Serious Driving Offense”** in 25 years Prevent Driver From Being Re-Licensed
3+ DWIs Alone in 25 Years Deny Re-License for 5 Years; After, Only a Restricted License with Interlock Ignition Device for Another 5 Year Period.

*All re-licensing will require “lifetime” reviews of the driving record.
**Serious Driving Offense- 20 points on license in 25 years, 2+ five point driving convictions, fatal crash, driving-related penal law conviction.

ONLY 15 DAYS TO CHALLENGE LICENSE SUSPENSION

After a person is arrested for DWI and refusing a chemical test, he/she only has 15 days from the date of his/her arraignment to be scheduled for a Chemical Test Refusal Hearing with the New York State Department of Motor Vehicles (DMV). Failure to appear at this hearing will result in automatic license suspension for one year, depending on the arrestee’s individual situation. NEW YORK STATE DWI LAW

Pursuant to New York State law, a person can be convicted of an alcohol related offense if:

  • The state can prove the accused was driving while their normal faculties were impaired OR
  • The state can prove that the accused was operating a motor vehicle with a Blood or Breath Alcohol Concentration (BAC) of 0.08% or higher
  • The state can prove that the accused was operating a motor vehicle while intoxicated.
